1. Acceptance of Terms

By purchasing, downloading, installing, or using Gallery Grab ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. Description of Service

Gallery Grab is a desktop application that automates the process of downloading photo galleries from your own accounts on third-party gallery hosting platforms. The Software operates by opening a browser window where you log in to your own account using your own credentials, then automating the navigation and download process on your behalf.

3. License Grant

Upon purchase of a valid subscription, you are granted a non-exclusive, non-transferable, revocable license to install and use the Software on one (1) machine at a time. You may deactivate your license from one machine and reactivate it on another machine at any time through the Software's Settings panel.

4. Subscription and Billing

• Gallery Grab is offered as an annual subscription at the price listed at the time of purchase.
• Subscriptions renew automatically each year unless cancelled before the renewal date.
• You may cancel your subscription at any time through your Lemon Squeezy account. Cancellation takes effect at the end of the current billing period.
• Refunds are available only as described in our Refund Policy. Because Gallery Grab is a digital product whose core value can be delivered in a single session, refund eligibility is limited to 48 hours from purchase and subject to usage limits. A free trial is provided so you can evaluate the Software before purchasing.

5. Free Trial

Gallery Grab offers a limited free trial of up to five (5) gallery downloads per user. The free trial requires an email address but does not require payment information. Free trial usage is tracked per email address and device combination.

6. Acceptable Use

You agree to:

• Use the Software only to download content from accounts that you own or have explicit authorization to access.
• Comply with the terms of service of any third-party platform you access through the Software.
• Not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software.
• Not redistribute, resell, sublicense, or share your license key with others.
• Not use the Software for any unlawful purpose.

7. Third-Party Platforms

Gallery Grab interacts with third-party gallery hosting platforms. Your use of any third-party platform through the Software remains subject to that platform's own terms of service. You are solely responsible for ensuring your use of the Software complies with the terms of any third-party platform you access.

8. Intellectual Property

The Software, including its code, design, documentation, and branding, is the intellectual property of Gallery Grab and is protected by applicable copyright and intellectual property laws. Your subscription grants you a license to use the Software; it does not transfer ownership of any intellectual property.

9. Data and Privacy

Your use of the Software is also governed by our Privacy Policy. Gallery Grab does not store, transmit, or have access to your login credentials for any third-party platform. Authentication occurs entirely within the browser window on your device.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GALLERY GRAB, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Software;
• Any changes to or termination of a third-party platform's service or terms;
• Any action taken by a third-party platform in response to your use of the Software;
• Any unauthorized access to or alteration of your data.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gallery Grab and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Software, your violation of these Terms, or your violation of any third-party rights or terms of service.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last updated" date. Your continued use of the Software after any changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your license at any time, with or without cause, with or without notice. Upon termination, your right to use the Software ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
